Terms of Service

These terms govern the use of vibecodly (the “Service”), the platform that lets you describe an app in plain language and generate it for iOS and Android. By creating an account or using the Service, you accept these terms. If you don't agree, don't use it.

1. Who provides the Service

vibecodly is operated from Argentina. For any legal matter, write to hola@vibecodly.app.

2. Your account

• You need an account (for example, with Google) to save and edit your apps. You can try the Service without signing up, with limits.
• You are responsible for the activity on your account and for keeping your credentials secure.
• You must be at least 16 (or the minimum age required in your country) to use the Service.
• One person or company, one account. Creating multiple accounts to bypass the free limits is prohibited.

3. Credits and plans

• The Service runs on credits: each generation or edit of an app, and each AI query your apps make, consumes credits.
• New accounts receive free credits. Paid plans include a monthly amount of credits, and you can buy top-ups.
• Credits are not money: they earn no interest, are not transferable or redeemable for cash, and are consumed as you use them.
• We only charge credits when a generation finishes successfully. If something fails on our side, you are not charged.

4. Payments, renewals and cancellation

• Subscription and top-up payments are processed through Stripe. We do not store your card details.
• Subscriptions renew automatically at the end of each period until you cancel.
• You can cancel anytime from the billing portal. Cancellation takes effect at the end of the period already paid; there is no pro-rated refund for the current period.
• Credits already used are not refundable (they have a real compute cost). If there was a mistake on our end, write to us and we'll fix it.
• We may change prices with reasonable notice; the change applies to the next billing period.

5. Your apps are yours

• You retain ownership of the content you upload (ideas, text, images, icons) and of the code of the apps you generate with the Service.
• You grant us a limited, non-exclusive, revocable license to host, process and display that content solely to operate the Service (generate, preview, build, back up).
• Showing your app in vibecodly's public gallery is optional and opt-in: we don't publish anything of yours unless you turn it on.
• You can export your project or sync it to your GitHub at any time. No lock-in.

6. Publishing to the stores

• Apps are published under your own Apple Developer and Google Play accounts. You are the developer before Apple, Google and your end users.
• You are responsible for complying with those stores' policies and the laws that apply to your app.
• We don't guarantee your app will be approved, and we are not responsible if a store rejects it, removes it, or suspends your developer account.

7. Third-party integrations

You can connect your own third-party accounts (Mercado Pago, Supabase, GitHub, RevenueCat, AdMob, Apple, Google). Those integrations are governed by each provider's terms. Any money your apps charge goes straight to your account: vibecodly is not an intermediary for those payments and holds no funds. You are responsible for the relationship with your end users, including their data, payments and claims.

8. Acceptable use

You may not use the Service to:

• Create illegal, fraudulent or deceptive apps or content, impersonate people or organizations, or violate third-party rights.
• Sexual content involving minors, incitement to violence, harassment, or material that infringes copyright or trademarks.
• Malware, spam, phishing, non-consensual mining, or any activity that harms others.
• Automate, resell or squeeze the Service beyond normal use (scraping, mass-generation scripts, bypassing usage limits or rate limits).
• Extract, probe or attempt to replicate the underlying AI models, or use the Service to train competing models.

9. AI-generated content

Apps are generated with artificial intelligence models. The result may contain errors, inaccuracies or parts that don't work as expected, and it may be similar to what another user receives from a similar idea. Review and test your app before publishing it or using it with real data. You are responsible for the final content you publish.

10. Our intellectual property

The platform, the generation engine, the “vibecodly” brand, the site and its design are ours. These terms don't transfer any rights over them to you, beyond the right to use the Service.

11. Availability and warranties

The Service is provided “as is”, without warranties of any kind, express or implied. We don't guarantee it will be error-free or available without interruptions: we rely on external providers (cloud, AI providers, app stores) that may fail or change their terms.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, data loss, or for the rejection, removal or malfunction of your apps. Our total aggregate liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or USD 50 if you paid us nothing).

13. Suspension and termination

You can close your account anytime by writing to us. We may suspend or close accounts that violate these terms, abuse the Service or create legal risk, with notice where reasonable. When your account is closed, your unused credits are lost and your projects may be deleted.

14. Changes to these terms

We may update these terms. If the change is material, we'll let you know by email or in the product. Continuing to use the Service after the change means you accept it.

15. Governing law

These terms are governed by the laws of the Argentine Republic, and any dispute is subject to the ordinary courts of the City of Buenos Aires, without prejudice to the rights you may have as a consumer in your country of residence.
